Welcome to our mobile first footage marketplace and smartphone application! This document - Terms & Conditions for SnapMedia - outlines the rules for our community. Please look it over and understand your rights and responsibilities. If you do not agree to its terms, you are restricted from using our services.
Here are the Terms & Conditions:
The parties.
Who "we" are.
Who "you" are.
"We" refers to internetusers, Inc. a Delaware corporation that owns and operates SnapMedia marketplace and smartphone application. You can find us at SmartMedia.agency.
"You" refers to any user of our website or smartphone application. You are also sometimes called a "User."
"Buyer" refers to any Person who is purchasing a license through our marketplace.
"Author" refers to the Person who created the video clip and owns the rights to it.
"Person" means an individual or legal entity, including a company or a governmental agency or instrumentality.
What We Do.
We operate a web marketplace and smartphone application for video footage. We provide a place where independent Authors can list their videos for sale and Buyers can view previews and purchase licenses to use them.
We do not own the videos. Instead, the independent authors retain the rights to their videos and sell to You a Standard License to use the video.

Standard License.
Standard Licenses grant the Buyer the right to use the clip in unlimited number of End Products. For more information, see our "Standard License".
What You Do.
How to become an Author?
If you want to sell your own clips, consider becoming an Author with us! Check out our "Sell Footage" page or use the smartphone application for more info or to create your Author account.
As an Author, you will also be bound by our Author Agreement, Privacy Policy and Standard License Agreement so make sure you understand your rights and responsibilities. (Authors are also bound by the Terms & Conditions for our website, the document you are reading right now.)
Remember: Our website and our smartphone application provides the ability (i) to upload high quality videos to the SnapMedia marketplace via your mobile device or web uploader, (ii) to browse the SnapMedia website and (iii) the ability to access certain features through SnapMedia application downloaded and installed on a mobile device. To the extent you use this and other SnapMedia features & services, your internet service provider's standard charges, wireless service carrier's standard charges, data rates and other fees may apply.
How to browse without becoming a Buyer or Author.
You may browse through our collection of clips with no obligation to purchase anything or create a Buyer or Author account. However, remember that you are still bound to our Terms & Conditions, as you are a member of the UnStock community. You are also bound by our Privacy Policy, so be sure to read that as well and make sure you stay up to date, as the terms change from time to time.
Buyers.
When you're ready to purchase a clip, you'll need to create a Buyer account. There's no cost to create an account, but you will need to give us some personal information. Keep in mind that you will be bound by our Privacy Policy, so you'll want to review that to make sure you agree to its terms and make sure you stay up to date, as the terms change from time to time.
The next question is - what are you actually buying? In making a purchase through our site, you are getting a license to use that item. We go through that in more detail below, and you can also read the fine print in our "Standard License" agreement.
Licensing - what are you buying, actually?
With Standard License You are purchasing the right to use the clip in unlimited End Products.
Licensing - what are you not buying?
You are not buying the following:
The right to use the clip exclusively. Others will be able to use the same clip.
Payment.
All license fees ("clip prices") are payable in advance in the manner set forth in the order form and are non-refundable, except as may be allowed in limited circumstances. All license fees are exclusive of all sales, use and excise taxes, and any other similar taxes, duties and charges of any kind imposed by any Governmental Authority on any amounts payable by Buyer. Buyer shall be responsible for all such charges, costs and taxes; provided, that, Buyer shall not be responsible for any taxes imposed on, or with respect to, Author's or SnapMedia income, revenues, gross receipts, personnel or real or personal property or other assets.
Download.
The selected clips will be available for download immediately after the receipt of all license fees. Company shall not be liable for any delays in payment processing. You shall be responsible for downloading and saving the clip as soon as you pay all license fees.
Refunds
In general, we do not offer a refund on the purchased clip. Given the nature of digital goods they can be previewed on our website before the purchase and after download you may use them immediately. However, if you think that we should issue a refund for your purchase you should send as an email to support@SnapMedia.agency.
Our Promises to Each Other.
Integrity is important to the success of the SnapMedia community. As such, we all make promises to each other.
Our Promises.
We promise the following:
Maintain a clean and comfortable marketplace. In other words, we reserve the right to terminate user accounts if they violate the marketplace rules.
Allow you to purchase, download clips and license certificates.
Your Promises.
You promise to honor the terms of the Privacy Policy, the Standard License you have purchased, and the Terms & Conditions of SnapMedia.
The Authors' Promises.
All Authors must make the following promises:
The work uploaded is owned by that Author.
No other individual, organization, or entity has a claim in this work.
The Author has obtained any and all required consents for models or intellectual property in this clip, the details of which are in each clip page.
The Author has not sold or licensed this clip in a way that would prohibit the granting of either SnapMedia Standard License.
Integration of Privacy Policy.
Our Privacy Policy sets out how we collect data and use the data we collect. It is incorporated into these Terms & Conditions for SnapMedia, so you will want to read it and make sure you consent. By using SnapMedia marketplace and/or smartphone application, you are consenting to the Privacy Policy. If you do not consent, you may not use SnapMedia marketplace and/or smartphone application.
Ownership of SnapMedia Intellectual Property.
For the purposes of this Agreement, the term, "IP" means all common law or registered trademarks, logos, service marks, trade names, Internet domain names, or other indications of origin now or in the future used by SnapMedia. Nothing contained herein grants or shall be construed to grant you any rights to use any SnapMedia IP.
You agree that you will not use Our IP in any manner that might tarnish, disparage, or reflect adversely on such IP or SnapMedia. Nor will you contest or otherwise challenge, or assist or encourage any other person or entity to contest or challenge, the validity of any of SnapMedia IP or the IP rights claimed by Us.
Changes to the Terms & Conditions for SnapMedia.
We update the Terms & Conditions for SnapMedia from time to time and reserve the right to do so at any time. When we make a significant change to our it, we notify our community either through an email or through a banner on the website. When you see such a notice, be sure to read the updated Terms & Conditions for SnapMedia, as it affects our relationship and how you can use this site. You should check the site periodically and stay current on updates.
